    Any business enterprise, whether as a principal or an accessory use, where persons utilize electronic machines, including but not limited to computers and gaming terminals, to conduct games of chance, including sweepstakes, and where cash, merchandise or other items of value are redeemed or otherwise distributed, whether or not the value of such distribution is determined by electronic games played or by predetermined odds. This term includes but is not limited to internet sweepstakes, electronic gaming operations or cybercafés, who have a finite pool of winners. This definition does not include any lottery approved by the State of North Carolina.

    Section 7, Page 70. Special Use Permit

    Special Use Permit: Internet Sweepstakes Cafes/Electronic Gaming Operations shall be allowed in the Commercial Zoning District as a special use. The special use permit shall be approved by the Bladen County Planning Board.

    Rules of Operation and Other Requirements

    1.

    No use permitted under this section may be located within 1,000 feet of another use permitted under this section.

    2.

    No use permitted under this section may be within 500 feet of any area zoned for residential use or from the property line of residential unit(s), churches, daycares, schools, or public parks in all zoning districts, which will be measured from the property line(s) containing such regulated use.

    3.

    Distances shall be measured using a straight line without regard to intervening objects or structures, from the closest exterior wall of the gaming establishment to the curtilage area (area of the property that is being maintained) of the religious use, school, daycare, residential district, or other electronic gaming establishment.

    4.

    If food or beverages are served, the establishment must meet the requirements of the Bladen County Health Department.

    5.

    The gaming operations shall be visible and open from the store front.

    6.

    All exterior windows shall not exceed a window tint of 35 percent.

    Firearms are prohibited

    8.

    Hours of operation shall be limited to 8:00 a.m. to 2:00 a.m. Monday — Saturday and shall not open until 2:00 p.m. on Sunday and remain open until 2:00 a.m.

    9.

    The establishment shall be restricted to patrons and employees at least 18 years of age.

    10.

    All terminals must be properly permitted and all applicable fees established for internet sweepstakes cafes by the Bladen County Board of Commissioners must be paid.

    11.

    Approval shall be obtained from the Bladen County Fire Marshal prior to occupancy and must comply with annual review standards.

    12.

    All zoning and building permits issued after August 20, 2012 for all sweepstakes centers shall be subject to an annual review and inspection (from the date of approval) to ensure compliance with this ordinance.

    13.

    The applicant will be responsible for all fees and costs which exceed the $200.00 special use permit fee.
